1. Services & Products
1.1 Digital Content and Commissions

  • Quarck.studio creates and sells original 3D art and graphics in digital formats (e.g., downloads) and by commission.

  • Ownership rights are retained by Quarck.studio. Purchasers receive a non-exclusive license for personal use only, unless commercial rights are explicitly purchased.

1.2 Physical Products (Prints)

  • Physical prints and merchandise are produced and shipped by Printful (the “Third‑Party Producer”).

  • Quarck.studio is not responsible for production, quality control, logistics, shipping, or any delays—these are managed by Printful.

  • All sales are final once fulfilled; please review Printful’s policies for returns, refunds, or exchanges.

2. Purchasing & Payment
2.1 Pricing

  • All prices are displayed in the currency specified at checkout, including applicable taxes where required.

  • Quarck.studio reserves the right to change prices without notice; however, confirmed orders remain at the price agreed at purchase.

2.2 Payment

  • Payments are processed via our payment gateway or through the Third‑Party Producer.

  • You agree to provide accurate payment information and authorize charges.

3. License & Intellectual Property
3.1 Digital Content

  • Upon purchase, you receive a limited license for personal, non-commercial use only. Any modification, redistribution, or commercial use must be authorized explicitly by Quarck.studio in writing.

3.2 Prints & Physical Merchandise

  • You may purchase physical prints or merchandise for personal use only. Commercial resale or reproduction is prohibited without express permission.

3.3 Ownership & IP Rights

  • All content on the Site is owned by or licensed to Quarck.studio and protected by copyright, trademark, and other intellectual property laws.

  • Unauthorized use, reproduction, or distribution is strictly prohibited.

4. Third‑Party Producer (Printful)
4.1 Fulfillment

  • Printful handles production, packaging, shipping, and direct customer service for prints and merchandise.

  • Quarck.studio does not guarantee delivery times, product quality, or availability—please refer to Printful’s Terms and Policies.

4.2 Returns and Refunds

  • Issues concerning print quality, damages, or non-delivery must be addressed directly through Printful’s returns and refund processes, which are available on their website.

5. User Conduct

  • You agree not to use the Site to:

    • Violate any laws or infringe on rights;

    • Upload malicious or harmful content;

    • Interfere with other users;

    • Impersonate anything;

    • Collect personal data of others unlawfully.

Violation of this may result in suspension, termination, or legal action.
6. Limitation of Liability

  • Quarck.studio is not liable for indirect, incidental, or consequential damages.

  • For physical products, liability is limited to Printful’s warranties and reparations.

  • Total liability to you will not exceed the total fees paid by you for the relevant order.

  • Quarck.studio makes no guarantees of availability, performance, accuracy, or fitness for any purpose.

8. Privacy

  • Your use of personal data is governed by our separate Privacy Policy, which outlines how we collect, use, store, and protect your information.
